Prayer behind the one who makes dua for the murtad ruler

Question:

Assalam alaykum wa rahmatullahi wa barakatuh,

Noble Shaykh,

What is the hukm (ruling) of Salat al Jumuah and the other salawaat (prayers), behind the imams who make dua for the Murtad (apostate) ruler? I have heard many sayings on this issue. And where should I pray if this is the case of most of the Imams and khatibs?

Answer:

Bismillah, wal hamdulillah wa salatu wa salamu ala rasoolillah,

Dear brother,

Assalamu alaykum

It is not necessary to leave the salaut ul Jammah (prayer in congregation), except behind the one who you are certain has fallen into a kufr which exits one from the milat (Relgion), as for the one who is other than that, from the one who has fallen into sins or bidah or deceit, then it is not allowed to use this as a reason to leave the salaut ul Jammah.

And if the khatib makes dua for the apostate ruler for guidance, or Tawfiq (sucess) to rule by the Quran and Sunnah or by whats Loved by Allah and He is Pleased with it or with what is good for the countries and people and things like this from the duas which do not fall under giving Nusrah (assistance) to the Tawaghit or to the kufr man made laws or giving them assistance over the Muwahideen (people of Tawheed), all of this is from the biddah that was not present in the best of generations (ie the time of the Salaf). And the ulaama consider dua on the minbar for the Muslim ruler who judges by the Shariah of Allah to be from the newly invented biddahs. So what about dua for other than them from the kaffir murtad rulers?

However this does not prevent praying the salut ul jammah behind these imams who make such dua. It does not fall under giving assistance to the tawhaghit and their shirk, as stated previously.

And its not necessary that this kind of biddah which doesn not reach the level of kufr, is used as a reason to leave the salat ul jammah.

And this is unless it is established to you with a clear daleel (evidence) that the imam or khatib is from the awliaya (ally) of the tawaghit or their helper, then in this case there is no salat behind him because then he is not from the Muslims – not the good or bad of them,even if they try to justify it with the saying of Ahlus Sunnah that the salat is prayed behind every Muslim good or bad (birr or fajr).
